Breath or Blood – Which One Should You Choose?

Most people believe that a blood test is the better option. The fact of the matter is that there are advantages and disadvantages with both tests in a Ventura DUI case.

Breath Test:

  • If your alcohol level is rising, it may be best to take a breath test, as it will be done sooner than the blood test. If the breath test is performed before your alcohol level rises to a .08, you may not even get arrested for a DUI in Ventura.
  • While the breath test sample cannot be retested, it is possible to attack both the accuracy of the machine and the competency of the officer using it.

Blood Test:

  • One clear advantage of the blood test is that your sample can be retested by an independent laboratory, both for alcohol level and to determine if the blood was drawn properly.
  • Additionally, if your alcohol level is falling, it would be wise to take the blood test, as it will take significantly longer to transport you to the hospital and take the blood.
