DMV Hearing (Administrative Per Se Hearing)
When you are arrested for DUI in Ventura County, the officers will nearly always take away your driver’s license and give you a “pink sheet” for a temporary driver’s license. The pink sheet is a part of the DS 367 Form, and expires 30 days after the date of arrest. You have 10 days to request a DMV hearing once you have been arrested. If you fail to request a hearing, your license will automatically be suspended by the DMV once the pink sheet expires.
When one of our Ventura County DUI defense attorneys is contacted within the 10 day period after arrest, we always inquire as to whether or not the DMV hearing has been requested. Because the DMV makes mistakes, we make all of our hearing requests via fax. The reason for this is that the fax gives us written proof that the DMV hearing was requested within the 10 day period, and leaves nothing to chance with the DMV. Assuming that the DMV hearing is requested within the 10 day period, the DMV will send a new white sheet to the address they have on file for you. The white sheet is your temporary driver’s license and it replaces your pink sheet, and it is valid pending the outcome of the DMV hearing.
