Probable Cause
Even if you have been pulled over for a valid reason, an officer must still have what is called “probable cause” to arrest you for a DUI in Ventura County. Whenever we review police reports on a Ventura County DUI case, we always analyze whether the arrest was made with probable cause. Such a determination usually involves the officer’s observations of you, your statements to the officer, and the length of time you were detained during the traffic stop. Whenever our Ventura County DUI attorney reads a report where the probable cause for arrest is lacking, we file a motion that forces the prosecution to prove that the Ventura County DUI arrest was lawful. If we are successful, then ALL of the post-arrest evidence against you (click here for a more detailed explanation) will be excluded from your case, and the prosecution may be forced to dismiss your Ventura County DUI case.
