Jail Time
Unlike other counties, you could be faced with having to do actual jail time in your Ventura County DUI case. On a standard first time Ventura County DUI, you will have the option of doing 48 hours of jail. If you do the time at the Ventura County Main Jail, you pick the time and the day that you want to remand yourself, and you get out 48 hours later. Many people choose to do their time over a weekend, from 7pm on Friday to 7pm on Sunday. This option works best for people who work a Monday through Friday, 9-5, and do not want to miss work or let their employers know about their Ventura County DUI case. Occasionally on cases involving an accident or extremely high alcohol levels, the District Attorney’s Office will seek more than 48 hours of jail time on a first time misdemeanor DUI – possibly up to 10 days. On a second time Ventura County DUI case, the potential jail sentence ranges from about 30 to 60 days, depending on your alcohol level, the age of the prior, whether or not there is a probation violation from the prior, and other factors. However, due to the fact that the jail is overcrowded, you end up doing about 2/3 of the total sentence. Work Furlough is a possible option on any sentence of 30 days or longer.
On a third time Ventura County DUI case, the potential jail sentence ranges from about 120 to 180 days, depending on your alcohol level, the age of the priors, whether or not there are probation violations from the priors, and other factors. However, due to the fact that the jail is overcrowded, you end up doing about 2/3 of the total sentence. Work Furlough is a possible option on any sentence of 30 days or longer.
